IMPLEMENTATION OF DISCRETION OF GOVERNMENT OFFICERS TO OVERCOME COVID-19 IN GOVERNMENT PROVINCE IN MALUKU PROVINCE

Abstract
The President of the Republic of Indonesia issued Presidential Decree No.11 of 2020 concerning the Determination of Public Health Emergencies for Corona Virus Disease 2019 (Covid-19), and therefore Indonesia is included in the category of Non-Natural Disasters, so that Government Officials can use discretion in the administration of the government during the Covid-19 pandemic to overcome government stagnation as a result of Covid-19 in Indonesia, including Maluku Province in accordance with the provisions in Law Number 30 of 2014. Legal facts prove that the use of discretion in governance in Maluku Province during the Covid-19 Pandemic has been in accordance with the objectives and requirements of discretion and uses the principles of good governance so that Good Governance is created in governance. This research uses the type of normative legal research, normative legal research is carried out to examine legal concepts related to regulations in the laws governing the use of discretion during the Covid-19 pandemic, and is assisted by empirical research to obtain field data on 3 (three) location of governance which includes Ambon City Government, Aru Islands Regency Government, and Pattimura University. The results show that the regional government and the Central Government have implemented discretionary authority in accordance with the terms of discretionary objectives to overcome Covid-19 both in issuing Regelling and Beschikking as well as diverting the 2020 Fiscal Year Budget so that the Covid-19 response can be overcome. Government Administration in overcoming Covid-19 with Government Discretionary Actions in relation to handling Covid 19 has not yet used the principles of good governance, so that good governance in government administration is not created during the handling of Covid-19. Recommendations to the government, namely the use of government discretion to tackle Covid-19 as a non-natural disaster, must still refer to Law Number 30 of 2014 regarding the nature, objectives and requirements of discretion. A further recommendation is that the use of discretion must use legality principles and general principles of government as a reference for government administration in tackling Covid-19 in Maluku Province.
